FAQ

Serving papers in Washtenaw County: common questions.

General information about Michigan court rules, not legal advice. Your attorney or the court clerk can answer questions about your specific case.

Who can serve legal papers in Michigan?

MCR 2.103(A) lets any legally competent adult who isn’t a party, or an officer of a corporate party, serve process. Writs of restitution and orders requiring arrest are the exception and need a sheriff, deputy, or court officer.

Can you serve someone who is in a hospital?

Yes, but differently. Under MCR 2.103(C), service on someone in a hospital, home, or government institution is made by the person in charge of the institution or their designee. We’ll coordinate that with the facility.

Is certified mail good enough?

It can be. MCR 2.105(A)(2) permits registered or certified mail with return receipt and restricted delivery. Service is complete only when the defendant acknowledges receipt, and the signed green card has to be attached to your proof of service.

Can I serve my ex myself?

No. A party to the case can’t serve process under MCR 2.103(A). A friend over 18 technically could, but a professional server avoids conflict and gives you a clean proof of service.

What does your proof of service include?

The name of the person served, the date, time, and address, how the papers were delivered, and our signature. That covers the facts MCR 2.104(A) requires for filing.
