FAQ

Serving papers in Southfield: common questions.

General information about Michigan court rules, not legal advice. Your attorney or the court clerk can answer questions about your specific case.

Who should be served when the defendant is a business?

An officer or the resident agent, under MCR 2.105(D) for corporations and MCR 2.105(H) for LLCs. A front-desk employee is usually not enough unless the rule’s registered-mail step is also completed.

What if the defendant is avoiding service?

We record each attempt. If service can’t reasonably be made, MCR 2.105(J) lets the court order another method on a verified motion, and that record supports it.

Can anyone serve papers, or do I need a professional?

MCR 2.103(A) allows any legally competent adult who isn’t a party or an officer of a corporate party. A professional server gives you a neutral witness and proper documentation.

How long do I have to serve?

A summons expires 91 days after issue under MCR 2.102(D). Send us the date so we can plan.
